The Friendly Accident Report Form (“Constatare amiabilă de accident”) is a simplified alternative to accident reporting through the Police. It allows you to document a traffic incident amicably, without the involvement of authorities. But only if certain legal conditions are met. Its use helps reduce the time required to open damage claim files and streamlines the compensation process within the car insurance system.

What is the friendly accident report?

The Friendly Accident Report Form is a tool officially introduced in Romania on July 1, 2009, under Order No. 21/2008 of the Insurance Supervisory Commission (CSA). Its purpose is to simplify the claims procedure in the case of minor road accidents, without the need for police intervention.

This form is available at all authorized insurance providers. It can be requested from a broker when signing the mandatory RCA insurance or downloaded online. It may be used regardless of the location of the accident as long as the event took place on Romanian territory.

The form can be completed and signed only if all the following conditions are met:

  • The accident resulted in material damage only, with no injuries or fatalities.
  • Only two vehicles were involved.
  • No other property or third parties were affected, other than the two vehicles involved.
  • Both drivers agree to complete and sign the form.

A special case provided by the regulations is when one of the vehicles is stationary or parked. In this situation, the form may be filled out only by the owner or user of the non-moving vehicle involved.

It is important to note that signing the form does not represent an admission of guilt by either driver. The purpose of the form is to provide technical and contextual information relevant to the opening of a damage claim.
The form requires details such as:

  • personal information of the drivers.
  • vehicle data, accident circumstances.
  • RCA insurance policies.
  • a sketch of the incident.
  • driver statements.

Once completed, each driver keeps a copy of the form.
Advantages of the Friendly Accident Report include: avoiding the need to visit the Police, reducing the time required to obtain compensation, and providing a clearer and more efficient procedure for minor accidents. Additionally, digital versions of the form exist (e.g., the “Amiabila” app), officially recognized, allowing drivers to fill out the form quickly on their phones.

Procedure after completion

The driver requesting compensation must contact the RCA insurer of the other driver, submitting the completed form to any of the insurer’s offices. Upon submission, the insurance company will issue a repair authorization document for the vehicle.
According to CSA Order No. 20/2008, the insured driver is required to immediately inform the insurance company about the occurrence of the accident. By doing this, the insurer initiates the damage claim file.
